Limited Warranty Product Coverage: Steel contained in the bases and uprights of the All Ball Pro Mini, Stinger X, Varsity, Premier XL, and Elite XL athletic ball rebounders.​

Limited Warranty Product Coverage: Net, knobs, wheels, skirting of the All Ball Pro Mini, Stinger X, Varsity, Premier XL, and Elite XL athletic ball rebounders 90 days 

a. All Ball Pro warrants to the consumer that the All Ball Pro Mini, Stinger X, Varsity, Premier XL, and Elite XL athletic ball rebounders (each a “Product,” and collectively, the “Products”), as listed above, will be free from defects in materials and workmanship for the duration specified above, which duration shall begin on the date of purchase by the customer. 

b. All Ball Pro’s Limited Warranty covers only those defects that arise as a result of normal use of the Product, and does not cover any other problems, including those that arise as a result of: 

i. Improper maintenance or modification; 

ii. Operation outside the Product’s original intent as an athletic ball rebounder; 

iii. Unauthorized modification or misuse of Product; or 

iv. Natural occurrences from nature, i.e. rust, fading. 

c. If All Ball Pro receives, during the applicable warranty period, notice of a defect which is covered by this Limited Warranty, All Ball Pro shall, in its sole discretion, repair, replace, or provide a part of the Product to cure the defect. All Ball Pro will notify the customer in the event the Product or issue with the Product is not covered by this Limited Warranty. 

d. If All Ball Pro is unable to cure the defect via the methods stated above, which shall be determined in All Ball Pro’s sole discretion, All Ball Pro may, within a reasonable time after being notified of the defect, refund the purchase price for the Product. 

e. All Ball Pro shall have no obligation to repair, replace, or refund until All Ball Pro receives the defective Product. The customer shall be responsible for all costs of shipment associated with this Limited Warranty. Any replacement Product may be new or like-new, provided that it has functionality at least equal to that of the replaced Product. All Ball Pro does not guarantee replacement with an identical Product; however, the Product shall be substantially similar. 

TO THE EXTENT ALLOWED BY LOCAL LAW, NEITHER ALL BALL PRO NOR ITS THIRD PARTY SUPPLIERS MAKES ANY OTHER WARRANTY OR CONDITION OF ANY KIND. WHETHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE. 

a. To the extent allowed by local law, the remedies provided in this Limited Warranty are the customer’s sole and exclusive remedies. 

b. TO THE EXTENT ALLOWED BY LOCAL LAW, EXCEPT FOR THE OBLIGATIONS SPECIFICALLY SET FORTH IN THIS LIMITED WARRANTY, IN NO EXTENT SHALL ALL BALL PRO OR ITS THIRD PARY SUPPLIERS BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

c. This Limited Warranty provides the customer specific legal rights. The customer may also have other rights which vary from state to state in the United States. 

d. To the extent that this Limited Warranty is inconsistent with local law, this Limited Warranty shall be deemed modified to be consistent with such local law. Under such local law, certain disclaimers and limitations of this Limited Warranty may not apply to the customer. 

THE TERMS IN THIS LIMITED WARRANTY, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT, OR MODIFY, AND ARE IN ADDITION TO, THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF THE ALL BALL PRO PRODUCTS TO SUCH CUSTOMERS.
